Terms of Service
Effective Date: December 1, 2025
Article 1 (Purpose)
These Terms of Service govern the rights, obligations, and responsibilities between Popup Studio Korea Ltd. (hereinafter referred to as the "Company") and users regarding the use of the Bkend service (hereinafter referred to as the "Service").
Article 2 (Definitions)
- "Service" refers to the backend development platform service provided by the Company, including features such as database management, API generation, user authentication, and file storage.
- "User" refers to members and non-members who use the Service provided by the Company in accordance with these Terms.
- "Member" refers to a person who has entered into a service agreement with the Company and has been assigned a user ID.
- "Organization" refers to a team unit created by or affiliated with a member, where projects can be managed and team members can be invited.
- "Project" refers to an individual application unit created within an organization, including databases, APIs, and storage.
Article 3 (Posting and Amendment of Terms)
The Company shall post the contents of these Terms on the initial screen of the Service for easy access by members. The Company may amend these Terms within the scope that does not violate applicable laws, and shall notify the effective date and reasons for amendment along with the current Terms on the initial screen of the Service at least 7 days before the effective date. However, for amendments unfavorable to members, notification shall be made at least 30 days in advance.
Article 4 (Service Description)
The main features of the Service provided by the Company are as follows:
- Database Management: Table creation, schema management, index management, and permission management
- Automatic API Generation: RESTful API endpoint generation and documentation
- User Authentication: Member management, authentication token issuance, and role-based access control
- File Storage: File upload, download, and multipart upload support
- Organization and Project Management: Team collaboration, member invitation, and role-based permission management
Article 5 (Formation of Service Agreement)
A service agreement is established when a person wishing to become a member agrees to the Terms and applies for membership, and the Company approves such application. The Company may refuse approval or terminate the service agreement for applications that fall under the following: using another person's name, providing false information, or failing to meet the requirements set by the Company.
Article 6 (Member Obligations)
Members shall not engage in the following activities:
- Registering false information when signing up or changing information
- Stealing or fraudulently using another person's information
- Engaging in activities that violate laws or public order using the Service
- Intentionally disrupting the operation of the Company's Service
- Infringing on the intellectual property rights of the Company, third parties, or other rights
Article 7 (Company Obligations)
- The Company shall not engage in activities prohibited by applicable laws and these Terms or contrary to public order, and shall make its best efforts to provide continuous and stable Service.
- The Company shall maintain security systems to protect members' personal information and shall publish and comply with the Privacy Policy.
- The Company shall address opinions or complaints raised by members regarding Service use when deemed justified.
Article 8 (Service Suspension)
The Company may temporarily suspend the Service in the following cases:
- Unavoidable circumstances due to maintenance, inspection, or replacement of service facilities
- When a telecommunications carrier regulated by the Telecommunications Business Act suspends its telecommunications service
- Other force majeure circumstances
Article 9 (Intellectual Property Rights)
Copyrights and intellectual property rights to the Service belong to the Company. However, rights to data and content created by members using the Service belong to those members. The Company shall not use members' data for purposes other than Service provision.
Article 10 (Disclaimer)
The Company shall be exempt from liability when unable to provide the Service due to force majeure such as natural disasters, wars, or service interruption by telecommunications carriers. The Company shall also not be liable for service interruptions caused by the member's own fault.
Article 11 (Limitation of Liability)
The Company shall not be liable for damages incurred by members in connection with the use of free services. For paid services, unless there is willful misconduct or gross negligence by the Company, the Company's liability for damages shall be limited to the fees paid by the member.
Article 12 (Termination of Agreement)
Members may terminate the service agreement at any time through the withdrawal function within the Service. If a member violates obligations under these Terms, the Company may request correction within a reasonable period and terminate the service agreement if not corrected.
Article 13 (Governing Law and Jurisdiction)
The interpretation of these Terms and disputes regarding Service use shall be governed by the laws of the Republic of Korea. In case of disputes between the Company and members regarding Service use, both parties shall negotiate in good faith. If no agreement is reached, the court having jurisdiction over the Company's headquarters shall have exclusive jurisdiction.
